Tenants: Housing Allowance & Utilities in Germany

Housing Allowance & Rent Subsidies 3 min read · published September 07, 2025

As a tenant in Germany you often face questions about housing allowance, utility charges or forms. This article explains clearly when housing allowance is paid, how to check utility bills and which forms or deadlines matter. I show calculation examples, name official legal references and procedural steps for applications or objections. The language stays simple so that you as a tenant can recognise your entitlements, meet deadlines and act appropriately in a dispute. For legal actions I explain which court is responsible and which common template forms are used so you can act purposefully and avoid unnecessary costs. Read the examples and check your documents before accepting payments or filing an objection.

What is housing allowance and who is eligible?

Housing allowance is a state subsidy for rent or housing costs for households with low income. Eligibility and amounts are regulated by the Housing Allowance Act (WoFG), and the municipal housing allowance office decides.[1] Typical examples: single parents with low income, pensioners on statutory pensions and households with temporary income losses may be eligible. The exact amount depends on household size, income and rent. For the application you need income proofs, the rental contract and, if applicable, proof of heating or operating costs.

In many cases a housing entitlement certificate helps access affordable housing.

Understanding the utility bill

Operating costs and their allocation are regulated by law, especially the Operating Costs Regulation and the Heating Costs Ordinance; check whether only allocable costs were billed.[4] Pay attention to the billing period, allocation keys and the landlord's obligation to present receipts.

  • First check whether the billing period is correct and no past years are being retroactively charged.
  • Request receipts in writing if individual items are unclear.
  • Compare allocation keys (per person, by living area or consumption-based) with the rental agreement.
Keep all receipts for at least two years.

Rights for defects and repairs

The landlord is obliged to maintain the rented property in a condition suitable for contractual use; the legal provisions are in the German Civil Code (BGB, §§ 535 ff.).[2] Report defects in writing, document photos and deadlines and set a reasonable deadline for remedy. If defects persist you can consider rent reduction, withholding or self-remedy, but seek legal advice beforehand.

Report defects in writing and set a deadline for the landlord to act.

Termination, eviction and courts

For terminations and eviction cases the procedural rules of the Code of Civil Procedure apply; in tenancy disputes the local court (Amtsgericht) is often competent in the first instance, the regional court for appeals and the Federal Court of Justice for precedents.[3] If you receive a termination, check deadlines and reasons immediately, document all deliveries and seek legal support if unsure. An unanswered termination can lead to an eviction suit that requires formal responses within short time limits.

If eviction is threatened, seek legal advice promptly.
